Shipping Policy

 

Free Domestic Ground Shipping

Lighting Reimagined offers FREE ($0.00) Complimentary Standard Domestic Ground Shipping on all orders above $99.00 on our website to all locations in the contiguous United States.  Any order equal to or below $99.00 will charged a $19.95 handling fee - this is to cover some of our costs from the manufacturers that are charging us for these orders.  If you place an order for special order products (those not listed on our website) by email with our Customer Care Team (or by phone:  877 237 9098), there may be additional shipping & handling charges for those respective items. Any order placed with expedited shipping (non-Standard Domestic Ground shipping) will include shipping & handling fees.

Shipping to Canada & Internationally

Lighting Reimagined does offer International Shipping across the world.  Any items purchased from Lighting Reimagined shipping internationally outside of the continental United States (including Hawaii, Alaska & Puerto Rico) are deemed as FINAL SALE & there are no returns, refunds or cancellation of such items. There is no warranty for any item shipped International. Make sure any item you purchase is of the correct voltage, sizing, or uses the correct electrical parameters that are required in your country. THERE ARE ABSOLUTELY NO EXCEPTIONS TO THIS POLICY.

Lighting Reimagined is not responsible for any currency conversion or foreign exchange risks associated with any transaction.  A customer whose functional currency is not the U.S. Dollar is solely responsible for such conversion & solely bears such risks.  

Alaska, Hawaii & Puerto Rico Delivery

Lighting Reimagined does ship to Hawaii & Alaska.  For these locations, additional shipping fees may apply. Any items purchased from Lighting Reimagined shipping internationally outside of the continental United States (including Hawaii, Alaska & Puerto Rico) are deemed as FINAL SALE & there are no returns, refunds or cancellation of such items. There is no warranty for any item shipped International. Make sure any item you purchase is of the correct voltage, sizing, or uses the correct electrical parameters that are required in your country. THERE ARE ABSOLUTELY NO EXCEPTIONS TO THIS POLICY.

Shipping & Delivery Lead Time

Lighting Reimagined partners with manufacturers across the globe to provide you the best assortment in modern luxury lighting & décor. Depending on the item ordered, it could be in-stock on shelf in a warehouse 5 minutes away from your door, or could be made-to-order domestically or overseas. These factors among many others could impact the lead time required to ship your order. We will seek to provide as much as information as possible before, during & after your order is placed in an effort to give you the most accurate status of where your order is.

How quickly you receive your order depends on the current processing time & the shipping method chosen at time of checkout, & Lighting Reimagined makes no guarantees on delivery timelines. In example, hypothetically if current estimate processing / lead time for a particular item is 1-business day & you select Standard (Ground) shipping (estimate typically 2 – 5 business day delivery), your item should hypothetically deliver in 3 - 6 business days. For standard Ground shipping, many of our items ship with no signature required upon delivery, although the shipping carrier or the delivery driver may nonetheless require a signature upon delivery.

Lead times vary across items & manufacturers – those in stock are estimated to arrive between 5 – 10 business days, whereas made-to-order can be estimated at 45-business days or longer to deliver. We estimate on average 1 – 2 business day processing for domestic shipments, with an average delivery to your door between 3 – 6 business days. Processing & Lead times are estimates & can vary based on stock levels, shipping location, mode of shipment, among other factors, & Lighting Reimagined does not guarantee specific delivery dates on orders. Estimated delivery dates may also change between the time you place your order & the time you receive your shipping confirmation.

  • Each item has a general availability message (indicating lead time) on our website
  • After your order has been placed on our website, or over the phone, our Customer Care Team will send you an email confirming the expected ship date & delivery date within 24-hours(for orders placed during business hours) to 48-hours(for orders placed over the weekend or on holidays)
  • When your order ships, you will receive an email from us with the carrier information & tracking number

All lead times & delivery times are estimates & do not constitute any guarantee on the part of Lighting Reimagined. We will not be responsible for expedited shipping charges or any other costs or issues arising from a manufacturer's error or delay in the production &/or shipping of items.

What if the estimated delivery date has passed & I do not have my order?

Please note that estimated delivery dates are estimates only & are not guaranteed. We seek to provide accurate estimates & accommodate you with resources to track your order, such as invoice details & carrier shipment tracking links. When an order is shipped, tracking information for such order can generally be accessed when logged in on our website.  Please access & review the tracking information on our website, & then read the following options if further assistance is needed:

  • If the order status indicates that the item has been shipped or the tracking number provided shows that the item has been delivered, please check with your neighbors or family members. Packages are occasionally left with neighbors, building manager, or similar parties., or are placed somewhere relatively safe such as your porch, garage or even behind bushes
  • If the tracking information indicates the package is being returned to us, or if the address is incorrect, it may have been undeliverable. Should you suspect that your package is undeliverable, please contact our Customer Care Team immediately via email (customercare@lightingreimagined.com) or phone (877 237 9098) so that we can assist with the issue in a timely manner

Delivery Attempts / Signature Required for Expedited Shipping

Typically, all expedited shipping items will require a signature upon delivery. Carriers (such as UPS) will typically make 3 attempts to deliver a package. If no one is present to accept the delivery after 3 attempts, the package will likely be returned to us.

Undeliverable Packages

Occasionally, packages are returned to us as undeliverable. When this happens, we automatically issue a refund for the merchandise. You as the customer are responsible to clear the balance of back-&-forth freight/shipping charges incurred on returned packages. Please note that all undeliverable or refused packages are subject to a 20% restocking fee. If the freight/shipping & restocking fees & charges are not cleared, the relevant account will be blocked from any future activity until all outstanding balances have been cleared.

We are unable to reship orders that are returned to us as undeliverable. If you still wish to receive your order(s), you will have to place a new order on the website or by contacting our Customer Care Team (customercare@lightingreimagined.com / 877 237 9098).

Tracking Your Order

When your order ships, you will receive a shipment confirmation email containing a tracking number for your shipment. This tracking number can be used to track your order on the relevant shipping carrier’s website.

When your order ships, a tracking number link will also be available for your order when logged into your account on www.lightingreimagined.com. You can use this link to track the status of your shipment.

Damaged Merchandise

In the unfortunate event that you receive damaged merchandise, please contact us immediately (customercare@lightingreimagined.com / 877 237 9098) & we will gladly work with you to help resolve the issue as quickly & efficiently as possible. Replacement glass & miscellaneous parts can often ship within a few business days.

You should inspect all shipments upon delivery & report any damage to us as soon as possible.  Claims of damage upon delivery reported more than  10-days after delivery may be subject to a restocking fee, & claims of damages upon delivery reported more than 30-days after delivery will not be accepted. We will generally issue a return call tag to pick up the damaged merchandise & we will then send you a replacement (if available) as soon as practicable. Please note that we need to either charge you for the replacement (which you will be refunded for when we receive the return of the original damaged item) or receive the damaged item prior to shipping out any replacements. We apologize for any inconvenience this may cause.

Low Stock / Backorders / Discontinuations

On occasion, stock levels for certain items may be low or zero, which could result in an order being backordered (delayed).  Lighting Reimagined will seek to notify you as soon as practicable after learning of any delay involving your order; however, there may be occasions where that information is unknown or unavailable to Lighting Reimagined.  

Manufacturers occasionally discontinue items – which can sometimes occur after you place an order, in which case our Customer Care Team will contact you as soon as practicable after we become aware of such discontinuation.  In these cases, we will refund you the full amount of the item ordered & help you choose an alternative that fits your needs, style & budget.

What if I live in Puerto Rico?

For Puerto Rico, additional shipping fees may apply.  Any items purchased from Lighting Reimagined shipping internationally outside of the continental United States (including Hawaii, Alaska & Puerto Rico) are deemed as FINAL SALE & there are no returns, refunds or cancellation of such items. There is no warranty for any item shipped International. Will you Ship to My PO Box?

Unfortunately, Lighting Reimagined cannot ship to PO Boxes or Military APO’s.

What if I need to Send a Message Regarding a Vacation-Hold or Do-Not-Ship before Requirements?

Please contact our Customer Care Team immediately upon order placement so that we can assist you with the appropriate arrangements.

What if I Need to Ship to Multiple Addresses?

Returns, Exchanges & Cancellations

 

Returns & Exchanges

We understand that, sometimes, items you purchase are simply not right for your environment. They do not match your décor, or you simply do not like them. If you are dissatisfied with an item for any reason, you may return the item to Lighting Reimagined within 30 days after delivery, or exchange it for something else (restocking fees may apply if the return process begins after 30-days of receiving product). We want to ensure you get the right product for your space and our unparalleled selection of modern luxury lighting & décor items from around the world helps make this happen.

To begin the return & exchange process:

  • Please contact our Customer Care Team (customercare@lightingreimagined.com, 877 237 9098) so we can help remedy your situation immediately
  • After contact, our Customer Care Team will work to provide a Return Merchandise Authorization (RMA) / return call tag – you will typically receive an email with the return address & RMA number within 10 - 14-business days after contacting us
  • Returned items must arrive back in New Condition including the box (please do not mark, damage or otherwise modify the packaging in any way)
  • Write the RMA Number on the Shipping Label
  • If return process begins within 30-days we will cover all Restocking Fees for return-eligible products (if return process begins after 30-days of receiving your product, a restocking fee up to 25% may apply)
  • In cases of returns & exchanges, you will be responsible for the return freight back to the applicable manufacturer (related fees & charges may apply)
  • In certain cases where a shipping return label was provided by Lighting Reimagined to you, the costs of return shipping will be deducted from any refunds for the returned item(s)
  • Please note that we do not accept in-person returns at our Littman Bros. Lighting, Schaumburg, IL showroom
  • Upon inspection of the returned item(s), a refund will be issued
  • All refunds will be issued to the purchasing credit card - it generally takes 10 - 14 business days for a refund to be issued (note that this timeframe is an estimate, not a guarantee, & refunds may take longer to be issued in certain circumstances)

Any item shipped back to Lighting Reimagined &/or the manufacturer without prior authorization will result in a minimum restocking fee of 50% of the purchase price of such item.  

Products Not Eligible for Returns & Exchanges

In addition, we apologize that we cannot accept returns on:

  • Custom, special & made-to-order (built-to-order) items
  • All Custom, special & made-to-order (built-to-order) items cannot be cancelled once production process has begun
  • Floor Models, Open Box, Closeout & Clearance Items
  • Large orders (for example, single fixtures over $5,000 & orders totaling over $5,000 on multiple quantities of the same fixture)
  • Any product that has been modified, installed or used in any way (including cut, clipped or stripped wires)
  • Items not in resalable, new condition or items missing the original packaging
  • Items not purchased from Lighting Reimagined
  • Items not purchased by the original customer (we require the original purchase receipt)
  • Any items that are listed on their respective product page on https://lightingreimagined.com that states returns & / or cancellations are not allowed

Further Disclaimers

  • Lighting Reimagined is not responsible for any labor costs resulting from defective, damaged or incorrect items
  • The customer is solely responsible for (and bears the risk of loss with respect to) returned merchandise until it is received by Lighting Reimagined or the designated manufacturer

Cancellations

No custom, special & made-to-order (built-to-order) items can be cancelled once the production process has begun.  If the order has already shipped prior to cancellation, it cannot be cancelled & the attempted cancellation will be treated as a return.  Cancellation fees may apply, & any cancellation fees imposed by the manufacturer will be your responsibility & will be deducted from any refund.

To request an order cancellation, please contact our Customer Care team (customercare@lightingreimagined.com or 877 237 9098). Please be sure to provide your name, address, Lighting Reimagined order number, item(s) to be cancelled, & the reason for your cancellation. After contacting our Customer Care Team, you will receive an email detailing your cancellation request.  After Lighting Reimagined has had a chance to review your cancellation request, & typically within 72-hours after we receive your cancellation request (although this window may be longer in certain circumstances, for example, where the order is complex or where holidays occur within the window), we will send you another email notifying you whether your cancellation request was accepted and, if so, detailing your cancellation.

If items requested to be cancelled have already shipped & are in transit to you, the items cannot be rerouted, redirected or cancelled. Should you need to return the item, please contact our Customer Care Team to begin a Return Merchandise Authorization request (please see above for that process).

NOTE:  Do not refuse delivery of non-damaged items. Delivery refusal may result in the loss of your product & may negate the possibility for a refund. You may also be charged for round-trip shipping fees if you refuse delivery.

Damaged & Defective Items

Unfortunately, sometimes items may have a manufacturer’s defect. Most items Lighting Reimagined offers have a one-year manufacturer warranty for defects. Lighting Reimagined does not warranty the items that we sell, but our team will seek to assist you in resolving any issues with the relevant manufacturer during the warranty period. Any qualifying defective item purchased from Lighting Reimagined that is returned within one (1) year after purchase may be either repaired or replaced, as determined in the company’s discretion. You will not be charged for repair fees & expenses for an item to the extent that such item is still under warranty & such warranty that covers such fees & expenses.  If you need to report a defective item, please contact our Customer Care Team (customercare@lightingreimagined.com or 877 237 9098). Once your claim request has been received, a member of our Customer Care Team will typically contact you within 48-hours of after receipt (although this window may be longer in certain circumstances, for example, where the claim is complex or where holidays or weekends occur within the window). In some cases it is possible to repair damages &/or defects with replacement parts. When this is the case, we reserve the right to utilize this as a solution.  

Shipments Claims

At times items can be damaged during the shipping process or arrive with parts or components missing in which case you must notify our Customer Care Team within 72-hours after delivery so that we can make assist with resolving any issues as quickly & cost-effectively as possible.  Lighting Reimagined cannot be held responsible for any missing or damaged goods if we are not notified within this time period. If you suspect that your Lighting Reimagined order was damaged during shipment, please contact us by email (customercare@lightingreimagined.com) or phone (877 273 9098). Please provide as much information as possible – including photos of the damaged product & packaging. Once your claim request has been received, a member of our Customer Care Team will typically contact you within 48-hours of receipt (although this window may be longer in certain circumstances, for example, where the claim is complex or where holidays or weekends occur within the window). In some cases it is possible to repair damages &/or defects with replacement parts. When this is the case, we reserve the right to utilize this as a solution.    

Warranties

Most items Lighting Reimagined offers have a one-year manufacturer warranty for defects. Lighting Reimagined does not warranty the items that we sell, but our team will seek to assist you in resolving any issues with the relevant manufacturer during the warranty period. Any qualifying defective item purchased from Lighting Reimagined that is returned within one (1) year after purchase may be either repaired or replaced, as determined in the company’s discretion. Manufacturer-backed warranties do not apply to items that are not defective - any non-defective item can only be returned in accordance with our return policy (as described above).

(d/b/a Lighting Reimagined), its affiliates & their respective owners, employees, suppliers & service providers shall not be liable for any indirect, special, consequential or incidental damages including, without limitation, lost profits or revenues, costs of replacement goods, loss or damage to goods or services arising out of the use of or inability to use this website or any item purchased from Lighting Reimagined or damages resulting from use of or reliance on the information present, even if Lighting Reimagined such other related parties have been advised of the possibility of such damages.

The Site is owned by Littman Bros Energy Supplies Inc. and is currently provided free of charge to users who agree to abide by these T&C's. Lighting Reimagined reserves the right to change the nature of this relationship at any time and to revise these T&C's from time to time as Lighting Reimagined sees fit. The receipt of an email order confirmation is simply a recognition that we have received your requested order and does not constitute an offer to sell. We reserve the right to limit the quantity of any item sold or prohibit a sale altogether

Purchasing & Pricing

 

In order to make a purchase, you must have a valid payment method on file with us. You are responsible for paying all fees and applicable taxes associated with our Services. If your payment method fails, or your account is past due, we may collect fees owed using other collection mechanisms. This includes, without limitation, charging a portion of the owed amount, charging other payment methods on file with us, retaining collection agencies and, for accounts over 180 days past due, deducting the amount owed from your approved online payment account. To ensure uninterrupted service and to enable you to conveniently make additional purchases, Lighting Reimagined will store and update (e.g., upon expiration) your payment method on file.

 

Our inventory availability and listing prices are subject to change at any time without notice. In order to maximize the selection of items available for sale, Lighting Reimagined reserves the right, in its sole discretion, to limit the amount of time an item may remain in a customer cart. Unfortunately, pricing or typographical errors may occur. In the event that an item is listed at an incorrect price or contains incorrect information due to an error in pricing or product information, Lighting Reimagined reserves the right, at our sole discretion, to refuse or cancel any orders placed for that item.

 

We reserve the right to cancel or suspend any promotion, discount, coupon or similar incentive before its originally stated expiration date without notice and at our sole discretion. Please note that only one account per delivery address may be eligible for promotional codes and discounts, including, but not limited to, new customer and first-time purchase promotions. Except as otherwise stated, all prices are quoted in U.S. Dollars and all promotions may be limited to U.S. customers.

 

Except as otherwise stated, the risk of loss for all products you order passes to you upon our delivery to the shipping carrier (such as FedEx, UPS or USPS).

You agree that you will not: (i) transmit via or through the Site any information, data, text, files, links, software, chat, communication or other materials that are or that Lighting Reimagined considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, racially or ethnically hateful or otherwise objectionable; (ii) attempt to transmit any “virus,” “trojan horse” or other software destruction or disruption device or any other instrumentality that is or could be used for "cyber-attacks"; (iii) intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to, any regulations having the force of law while you are using or accessing the Site or in connection with your use of the Site, in any manner; and (iv) invade the privacy or violate any personal or proprietary right (including intellectual property rights) of any person or entity.

 

Indemnity

 

By using the Site, you agree to indemnify, defend and hold harmless Littman Bros Energy Supplies Inc. (d/b/a Lighting Reimagined), its affiliates and their respective owners, employees, suppliers and service providers (collectively, the "LR Parties"), and any other parties as determined in the discretion of Littman Bros. Energy Supplies Inc., from and against any and all claims, damages, losses, liabilities and causes of action (including expenses and attorneys' fees) incurred by or threatened against them arising out of or relating to your breach or alleged breach of these T&C's (including, without limitation, claims made by third parties for infringement of intellectual property rights). You agree to fully cooperate in the defense of any such claim. Lighting Reimagined reserves the right to assume, at your expense, the exclusive defense and control of any matter subject to indemnification by you.

 

Disclaimer, Limitation of Liability

 

The Site is provided by Lighting Reimagined on an “as is” and “as available” basis. Lighting Reimagined makes no representations or warranties of any kind, express or implied, as to (1) the operation of the Site, (2) the quality, accuracy, completeness or validity of any materials on the Site, or the information, content, materials or products included on the Site, or (3) whether the functions contained on the Site will be uninterrupted or error-free, or that defects will be corrected, or (4) implied warranties, including, but not limited to, implied warranties of title, merchantability or fitnesss for a particular purpose.  While we make every effort to provide accurate information, inaccuracies or errors may occur, including, without limitation, with respect to price information and product specifications and limitations.  In the event that we become aware of an error in pricing or other product information in connection with an item you purchased, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you about the cancellation. No LR Party is responsible or liable for any special, incidental, consequential, punitive or other indirect damages that result from the use of, or the inability to use, the Site or the information contained on the Site, even if that party has been advised of the possibility of such damages. In no event shall the aggregate liability of all LR Parties to you for any damages, losses and causes of action resulting from your use of the Site, whether in contract, tort (including, but not limited to, negligence) or otherwise, exceed one dollar (US $1.00).

In the event these T&C's are terminated, the restrictions regarding Materials appearing on the Site, and the representations and warranties, indemnities and limitations of liabilities set forth in these T&C's will survive termination. In the event that you are dissatisfied with the Site or the services provided by Lighting Reimagined, your sole remedy is to terminate your use of the Site.

 

Governing Law, Jurisdiction and Dispute Resolution

 

Jurisdiction

 

Lighting Reimagined operates the Site from its offices within the United States. Lighting Reimagined makes no representations that content and materials on the Site are legal or appropriate for use from outside the United States. If you choose to access the Site from other locations, you do so at your own risk and are responsible for compliance with all applicable laws You may not use the Site in violation of U.S. export laws and regulations.

 

Governing Law

 

These T&C's will be governed by and construed in accordance with the laws of the State of Illinois, as it is applied to agreements entered into and performed therein and without regard to principles of conflicts of law, and excluding (i) the United Nations Convention on Contracts for the International Sale of Goods; (ii) the 1974 Convention on the Limitation Period in the International Sale of Goods; and (iii) the Protocol amending the 1974 Convention, done at Vienna April 11, 1980.

 

Notwithstanding anything contained in these T&C's to the contrary, Lighting Reimagined shall have the right to institute judicial proceedings against you or anyone acting by, through or under you, in order to enforce Lighting Reimagined’s rights hereunder through reformation of contract, specific performance, injunction or similar equitable relief.

 

Any claim or cause of action you have with respect to use of the Site must be commenced within one (1) year after the claim arises. If any provision of these T&C's is deemed void, unlawful or otherwise unenforceable for any reason, that provision will be severed from these T&C's (to the maximum extent necessary) and the remaining provisions of these T&C's will remain in full force and effect. These T&C's constitute the entire agreement between you and Lighting Reimagined concerning your use of the Site.

 

Agreement to Arbitrate

 

You and Lighting Reimagined agree that any dispute, claim or controversy arising out of or relating to these T&C's or the breach, termination, enforcement, interpretation or validity thereof or otherwise relating to the Site, including, without limitation, with respect to the use thereof, the content thereon and the products purchased thereon (collectively, “Disputes”) will be settled by binding arbitration, except that each party retains the right: (i) to bring an individual action in small claims court and (ii) to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents or other intellectual property rights (the action described in the foregoing clause (ii), an “IP Protection Action”). Without limiting the preceding sentence, you will also have the right to litigate any other Dispute if you provide Lighting Reimagined with written notice of your desire to do so by email at customercare@lightingreimagined.com within thirty (30) days following the date you first agree to these T&C's (such notice, an “Arbitration Opt-out Notice”). If you don’t provide Lighting Reimagined with an Arbitration Opt-out Notice within the thirty (30) day period, you will be deemed to have knowingly and intentionally waived your right to litigate any Dispute except as expressly set forth in clauses (i) and (ii) above. The exclusive jurisdiction and venue of any IP Protection Action or, if you timely provide Lighting Reimagined with an Arbitration Opt-out Notice, will be the state and federal courts located in the State of Illinois and you and Lighting Reimagined each waives, to the fullest extent permitted by law, (i) any objection to jurisdiction and venue in such courts, including any claim that any Dispute brought in any such court has been brought in an inconvenient forum and (ii) any right to trial by jury with respect to any Dispute. If you do not timely provide Lighting Reimagined with an Arbitration Opt-out Notice, you acknowledge, understand and agree that you and Lighting Reimagined are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Further, unless both you and Lighting Reimagined otherwise agree in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of any class or representative proceeding. If this specific paragraph is held unenforceable, then the entirety of this “Dispute Resolution” section will be deemed void. Except as provided in the preceding sentence, this “Dispute Resolution” section will survive any termination of these T&C's.

 

Arbitration Rules

 

The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer-Related Disputes (the “AAA Rules”) then in effect, except as modified by this “Dispute Resolution” section. (The AAA Rules are available at https://www.adr.org/Arbitration or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this section.

 

Arbitration Process

 

A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules. The arbitrator will be either a retired judge or an attorney licensed to practice law and will be selected by the mutual agreement of the parties from the AAA’s roster of arbitrators. If the parties are unable to agree upon an arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the arbitrator in accordance with the AAA Rules.

 

Arbitration Location and Procedure

 

Unless you and Lighting Reimagined otherwise agree, the arbitration will be conducted in Cook County, in the State of Illinois. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of the documents that you and Lighting Reimagined submit to the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.

 

Arbitrator’s Decision

 

The arbitrator will render an award within the time frame specified in the AAA Rules. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitrator’s award of damages must be consistent with the terms of the "Indemnity" and "Disclaimer & Limitation of Liability" sections above as to the types and amounts of damages for which a party may be held liable. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant’s individual claim. If you prevail in arbitration you will be entitled to an award of attorneys’ fees and expenses, to the extent provided under applicable law. Lighting Reimagined will not seek, and hereby waives all rights it may have under applicable law to recover, attorneys’ fees and expenses if it prevails in arbitration.

 

Fees

 

We will pay all filing and administration fees charged by the administrator and arbitrator fees up to $1,000, and we will consider your request to pay any additional arbitration costs. If an arbitrator issues an award in our favor, you will not be required to reimburse us for any fees we have previously paid to the administrator or for which we are responsible. If you receive an award from the arbitrator, we will reimburse you for any fees paid by you to the administrator or arbitrator, up to $1,000. Each party shall bear its own attorney's, expert's and witness fees, which shall not be considered costs of arbitration; however, if a statute gives you the right to recover these fees, or fees paid to the administrator or arbitrator, then these statutory rights will apply in arbitration.

 

Changes

 

Notwithstanding the provisions herein relating to how we can make changes to these T&C's, if Lighting Reimagined changes this “Governing Law, Jurisdiction and Dispute Resolution” section after the date you first accepted these T&C's (or accepted any subsequent changes to these T&C's), you may reject any such change by sending us written notice within 30 days of date when such change became effective on the Site, as indicated in the “Last Updated” date above.  By rejecting any change, you are agreeing that you will arbitrate any Dispute between you and Lighting Reimagined in accordance with the provisions of this “Governing Law, Jurisdiction and Dispute Resolution” section as of the date you first accepted these T&C's (or accepted any subsequent changes to these T&C's).

 

Changes to These T&C's

 

Lighting Reimagined reserves the right, in our sole discretion, to change or modify portions of these T&C's at any time without notice. You should periodically visit this page to review the current T&C's so you are aware of any revision to which you are bound. If we make any changes to these T&C's, we will post the changes to these T&C's on this page and will indicate at the top of this page the date these terms were last revised.

 

Any such changes will become effective for existing users no earlier than ten (10) days after they are posted, except that changes addressing new functions of the Site or changes made for legal reasons will be effective immediately. Your continued use of the Site after the date any such changes become effective constitutes your acceptance of the new T&C's. Data Retention and Deletion

California Consumer Privacy Act of 2018; Effective January 1, 2020:

 

Consistent with the California Consumer Privacy Act of 2018 (the "CCPA"), this Privacy Policy for California Residents (this "Policy") supplements the information already contained in Lighting Reimagined's general Privacy Policy and applies solely to all users, visitors and others who reside in the State of California.  Capitalized terms used but not defined in this Policy have the meanings given to them in Lighting Reimagined's general Privacy Policy.

This Policy details the Personal Information that we may collect from you when you visit our Site and make use of the Lighting Reimagined services.
